The AI bid governance gap
Bid teams adopted generative AI faster than almost any other function. The legal, commercial and reputational obligations attached to that adoption have not yet caught up inside most organisations. This is what that gap looks like in practice.
The EU AI Act came into force on 1 August 2024. Article 4 AI literacy obligations have applied since 2 February 2025, and Article 26 deployer obligations become fully enforceable on 2 August 2026. Most bid teams cannot evidence training, defined deployer roles, or a documented governance framework. The penalty regime for general infringements runs to 7.5 million euros or 1.5 percent of global turnover.
PPN 017 has put AI disclosure questions into UK central government tenders. Contracting authorities are asking suppliers to describe how AI is used in bid preparation, what controls are in place, and who is accountable. Organisations that cannot answer credibly are signalling governance immaturity to evaluators at the precise moment they are trying to win the work.
CVs, references, named personnel and case study data are personal data. Processing them through public AI tools without a data processing agreement and a lawful basis is a UK GDPR breach. Most bid teams are doing this every day without realising it. ICO penalties run to 17.5 million pounds or 4 percent of global turnover.
